Payment and ordering Terms

  1. To secure your booking, a 50% deposit of your session fee is required. The remaining 50% balance is due two weeks before your session or due date. If the final payment is not received by this time, your session will be placed on hold and can be rescheduled once the balance has been paid in full.
  2. We totally get that sometimes things come up and you might need to cancel or reschedule. Just make sure you give us at least 48 hours notice for re schedules and 14 days for cancellation or we’ll have to hold on to your deposit (we promise we’ll take good care of it).
  3. Your deposit can be refunded as long as the cancellation is not within 14 days. However any bank fees we have incurred do not get refunded. For example if you pay $250 and we receive $245 after bank fees – then your refund will be $245.
  4. All Design and Ordering Appointments must take place within 4 weeks of your gallery being ready.
  5. All orders must be paid in full at your Design and Ordering Appointment. We accept bank transfer, card and cash. We also have Payright and a Direct Debit system with Ezi Debit so you have the flexibility of paying for your products weekly, fortnightly or monthly. For more information click here.
  6. Any inclusions in your package or on your voucher are void if not used at your Design and Ordering Appointment.
  7. Any images NOT purchased during your Design and Ordering Appointment are held for 7 days and then archived for 3 weeks. In order to re access the images or have another Design and Ordering Appointment there is a $75 fee.
  8. As you can appreciate, safe data storage space is a costly process, especially with the amount of data each shoot creates. IN order to maintain our safe storage capacity we need to sometime move things along to make room for new galleries. After being archived for 3 weeks, any un ordered images are deleted. 
  9. If payment has not been received within 30 days of the appointment, your images may be archived. An archiving fee of $75 will apply to reaccess the images. If payment remains outstanding after 90 days, Kristy’s Studio reserves the right to permanently delete the images without further notice. Due to the digital nature of our products and limited storage capacity, no responsibility will be taken for images that are deleted after the specified time frame.
  10. Due to the digital nature of our products, there are no refunds offered for any reason once your images have been emailed to you.

Session Terms

  1. Weekends are like unicorns – rare and magical. That’s why we reserve them for Complete Experience sessions only. We want to make sure we have enough time to capture all your special moments without rushing.
  2. Time is precious, especially when it comes to photography. If you’re running late, unfortunately it eats into your session time. We want you to get the most out of your session so make sure to come on time and avoid any stress!
  3. We like to think of ourselves as a mini zoo, so we have two cute bunnies. They won’t be present during your session, but we just wanted to give you a heads up in case you have allergies. Don’t worry, they won’t steal the spotlight from you!
  4. Studio Conditions of entry
  5. We want to make sure everyone stays safe and sound in our studio, so please keep a watchful eye on your little ones. We’ve got some cute critters, a lovely pond, and some nifty tech gear around, so let’s all do our best to avoid any damages! Oh, and watch out for the walkways when it’s wet – they can be slippery, like a penguin on ice!
  6. Sorry, parents and caregivers, but no prams allowed inside. We’re keeping our studio wheels-free, so let’s avoid any wheelie mishaps.
  7. If you or your kiddos aren’t feeling so hot, let us know! We don’t want any yucky germs spreading around our space.
  8. Complimentary gift voucher / competition prize Terms
  9. We’re dishing out some amazing studio sessions, but there are a few things you need to know. First off, our offer can’t be exchanged for cold, hard cash. We know, we know, money talks, but trust us, our sessions are worth their weight in gold!
  10. Next up, we’re not playing second fiddle to any other offer out there. Sorry, no combo deals or discounts allowed. We’re like the cool kid in school – confident, unique, and not afraid to stand out from the crowd.
  11. Now, let’s talk about timing. Our complimentary studio sessions are good for 3 months, but only on weekdays. 
  12. No cameras, mobile phones, tablets or smart devices are to be used in the studio please. Under no circumstances can you stand behind me and take snaps on your device. You can shoot BTS style that includes me in them.
  13. Please be aware of your child’s safety outside the studio. There is a pond, 2 bunnies and both neighbours have a large dog. The paths can get slippery when wet. Parental supervision is required at all times.
  14. Within the studio itself there are a lot of cables and things to trip over. Please be very aware and watch your children.
  15. When trying to get babies/children’s attention for a photo – please stand right behind me and as close to my camera as possible – we want great smiles, but we want them to be looking at the camera when they do it!

Portrait Agreement

THE CLIENT

  1. I/we authorize the Studio to arrange the photography in accordance with the details overleaf. I/we are satisfied that these details are correct and I/we understand there is a three working day cooling-off period from the date of the signing this contract before the photography is commenced and for any orders placed.
  2. I/we authorize the Studio to photograph any minors present at the session and agree to all terms on their behalf
  3. I/we have received, read and understand the Studio’s price list, which has been confirmed for our assignment on payment of the deposit.
  4. The details and times listed here from part of this agreement and I/we agreed to make every effort to cooperate in order for the Studio to fulfil its contracted photographic duty. I/we acknowledge the Studio cannot accept responsibility for the ‘extent’ of the photographic coverage if these details are incorrect or if I/we chose not to follow the agreed to schedule.
  5. To avoid disruption to the photographic coverage and to allow the Studio to fulfil its contracted duty; other photography by family/friends at this time is not permitted.
  6. The Studio is not responsible for meeting dietary requirements. All our cakes are made by professional bakers and contain egg, sugar, gluten, nut and dairy. If your child has special dietary requirements, you must provide the cake. 
  7. The Studio is not liable for any allergic or intolerant reactions to the cake. We advise that you give your child cake in the weeks leading up to the cake smash.
  8. Please note that if you wish to use your $300 Credit it must be used at your Design and Ordering Zoom Appointment with Kristy after your photo shoot session. Any Digital Images,  Wall Art and Album purchases after that appointment will be required to be paid in full. 
  9. All orders shall remain the property of the Studio until full payment has been made. Orders cannot be separated for collection unless paid for in full.
  10. Should I/we fail to pay and collect any order within fourteen (14) days of notification of completion, the order shall be in default and the Studio shall charge a default charge of 1.5% per month (18% annual rate) on the unpaid balance (minimum monthly charge of $5.00). In addition, I/ we acknowledge that no future orders will be processed until the Order is paid in full.
  11. While every reasonable effort is taken to minimize the spread of illness, it is not possible to completely remove the risk of the spread of all illnesses or diseases. You may need to postpone your session due to illness or the risk thereof. If you are unwell or your child is unwell – please reschedule your session for the safety of Kristy AND her other clients. 
  12. The Studio has no control over the environment in which the photographs are kept and that colour photographs, in common with all sensitised material and colour dyes, have limited life expectancy which is minimised when exposed to strong and prolonged sunlight, heat or fluorescent light sources. Photographs will last longer if displayed under better lighting conditions.
  13. If any photography equipment (including but not limited to cameras, lenses, lights, etc.) is damaged beyond normal wear and tear due to malicious acts or negligence by the Client or by any other attendee of the session, Client agrees to pay any and all repair or replacement charges.
  14. Images are completed 1 month from the date of the shoot. The Studio will inform the client of any delays to this timeframe. The client understands that this is an approximation and that any longer period required to complete the product will not void / alter any part of this contract.
  15. The Client understands that The Studio cannot force a baby to smile. Safety is our first priority when photographing your children. The Client trusts The Studio’s opinion on when a session needs to end, if a session needs to be rescheduled, if a baby is unable to go into a certain pose.
  16. The images in the gallery shown are final.
